1. Acceptance of Terms and Assumption of Risk
By registering for an American Association of Nurse Practitioners® (“AANP”) conference (the “Event”), and for and in consideration of AANP allowing me to register, attend, and participate in the Event, I, for myself and on behalf of my spouse, children, guardians, heirs and next of kin, and any legal personal representatives, executors, administrators, successors and assigns, hereby agree to RELEASE, WAIVE, AND COVENANT NOT TO SUE, and assume all risks associated with transportation to and from, attendance at, and participation in the Event.
I ACKNOWLEDGE AND UNDERSTAND THAT PARTICIPATION IN THE EVENT MAY INVOLVE INHERENT AND OTHER RISKS, INCLUDING BUT NOT LIMITED TO RISKS ARISING FROM TRAVEL, SLIPS, TRIPS, AND FALLS, FOODBORNE ILLNESS OR ALLERGIC REACTIONS, USE OR FAILURE OF EQUIPMENT, ACTIONS OR INACTIONS OF OTHER PARTICIPANTS OR THIRD PARTIES, INTERACTIONS WITH EXHIBITORS AND SPONSORS, RISKS ASSOCIATED WITH LARGE-GROUP EVENTS (INCLUDING CROWD DENSITY AND LIMITED EGRESS), AND EXPOSURE TO COMMUNICABLE DISEASES. I EXPRESSLY AND VOLUNTARILY ASSUME ALL SUCH RISKS, WHETHER KNOWN OR UNKNOWN, FORESEEABLE OR UNFORESEEABLE.
2. Release, Waiver, and Indemnification
I further agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS
AANP, Corcoran Expositions, Inc., and their respective employees, officers, directors, administrators, agents, contractors, instructors, speakers, members, other participants, exhibitors, sponsors, vendors, and hosting hotel, convention center, or venue (collectively, the “Released Parties”) from any and all liability, claims, judgments, costs (including reasonable attorneys’ fees), demands, losses, or damages arising out of or related to my attendance at or participation in the Event, INCLUDING ANY CLAIMS ARISING FROM THE NEGLIGENCE (WHETHER SOLE, JOINT, OR CONCURRENT) OF THE RELEASED PARTIES, but excluding claims arising from their gross negligence or willful misconduct, to the extent such exclusion is required by applicable law.
THIS AGREEMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED BY APPLICABLE LAW.
3. Medical Treatment Authorization
I hereby consent to receive any emergency medical treatment that may be deemed necessary in the event of injury, illness, or other medical condition arising during or in connection with the Event. I understand and agree that I am solely responsible for all costs associated with such medical treatment and release the Released Parties from any liability arising from the rendering or failure to render such care.
4. Third-Party Vendors, Exhibitors, and Sponsors
I acknowledge that the Event may involve third-party vendors, including but not limited to venues, hotels, caterers, service providers, exhibitors, and sponsors, and that the Released Parties do not own, operate, or control such third parties. I further acknowledge that interactions with exhibitors and sponsors, including demonstrations or use of products or services, are undertaken at my own risk.
During the Event, AANP provides badge scanning technology that allows exhibitors or vendors to collect attendee contact and professional information.
Attendee participation in badge scanning is voluntary. By allowing your badge to be scanned, you consent to the sharing of your contact and professional information, which may include details such as your name, contact information, professional credentials, and other registration data provided to AANP.
AANP facilitates this data exchange but does not control the exhibitor’s or vendor’s subsequent use of personal data. Exhibitors and vendors are responsible for their own compliance with applicable data protection laws and for providing information about their privacy practices. If you wish to access, correct, or delete any personal information collected by an exhibitor or vendor, you must contact that party directly.
I AGREE THAT THE RELEASED PARTIES SHALL NOT BE LIABLE FOR ANY ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, OR NEGLIGENCE OF SUCH THIRD PARTIES.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE EVENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE TOTAL LIABILITY OF THE RELEASED PARTIES EXCEED THE AMOUNT OF REGISTRATION FEES PAID BY ME, IF ANY.
6. Participant Conduct and Removal
AANP reserves the right, in its sole discretion, to remove or exclude any participant from the Event at any time for conduct that AANP deems inappropriate, disruptive, unsafe, or in violation of applicable policies or laws, without refund or liability of any kind.
7. Event Cancellation and Force Majeure
In the event that AANP cancels, postpones, or is unable to hold the Event due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, strikes, labor disputes, governmental actions, or failures of utilities or transportation, AANP shall not be liable for such failure or delay, and its sole obligation shall be, at its discretion, to reschedule the Event or refund any registration fees paid.
8. Insurance Disclaimer
I understand and agree that the Released Parties do not maintain any insurance coverage for my benefit, including but not limited to health, medical, travel, or liability insurance, and that I am solely responsible for obtaining any such coverage.
9. Registration Restrictions
I agree not to allow any other individual to attend the Event in my place.
10. Media Release
I consent to AANP using any photographs, video recordings, or other images of me, and any results of Event-related activities, for media outreach, promotional campaigns, publications, or other lawful business purposes.
11. Electronic Communications Consent
I consent to receive communications from AANP by email and agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
12. Governing Law and Venue
This agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to this agreement or the Event shall be brought exclusively in the state or federal courts located in Travis County, Texas, and I hereby irrevocably consent to the jurisdiction of such courts and waive any objections based on venue or forum non conveniens.
13. Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE EVENT.
14. Severability and Entire Agreement
If any provision of this agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. This agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous agreements or understandings, whether written or oral.
15. Minors
If I am registering on behalf of a minor, I represent and warrant that I am the parent or legal guardian of such minor and have full authority to execute this agreement on their behalf, and I agree to indemnify the Released Parties for any claims arising from a breach of this representation.
16. Acknowledgment and Agreement
BY REGISTERING FOR THE EVENT, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE AANP CONFERENCE TERMS OF SERVICE AND RELEASE OF LIABILITY. I HAVE HAD THE OPPORTUNITY TO REVIEW THESE TERMS PRIOR TO REGISTERING. I ADDITIONALLY AGREE TO ABIDE BY AANP’S TERMS OF USE AND PRIVACY POLICY. IF I DO NOT ACCEPT THESE TERMS, I WILL NOT COMPLETE MY REGISTRATION FOR THE EVENT.
